1.1. These Terms and Conditions of Sale (“Sales Terms”) provide you with information about Fernando Jorge and the legal terms and conditions (“Terms”) on how we sell any of the Products (“Products”), which apply to any sales or services provided by us to you through our various channels of sales, including the website (https://fernandojorge.co.uk) (“Website” or “Site”) and any associated mobile or digital applications.

1.2. These Terms are the contract (“Contract”) between us for the sale of Products to you, the individual placing an order (“you”). Please read them carefully and make sure you understand them fully, before finalising your purchase. Kindly note that you will be asked to agree to our Terms and Conditions before placing an order. Where you do not accept these Terms and Conditions in full, you do not have permission to place an order with us or access the contents of this website and should cease using it immediately.

Please do not hesitate to contact us should you have any questions.

1.3. You should print a copy of these Terms or save them to your computer for future reference.

1.4. We reserve the right to amend these Terms at any time. We may revise these Terms as they apply to your order to reflect changes in relevant laws or regulatory requirements. Every time you wish to order Products, it is your responsibility to review our Terms to ensure you understand our Terms at the time of purchase.

2.1. We are Fernando Jorge Limited (“We” or “Us” or “Our”) a company registered in England and Wales. Our company registration number is 07906198 and our registered office is at 4 Garden Walk, London, EC2A 3EQ, UK. Our VAT number is 129 3511 23.

2.2. You can contact us by telephoning our customer service team at +44(0)20 7729 0126 during our UK opening hours Monday-Friday 9:30am – 6pm or by emailing us at  [email protected].

2.3. If we have to contact you, we will do so by email at the email address provided by you in your order or contact you via phone should we have a number on file.

2.4. You are the individual placing the order. You must be 18 years or over to place an order and enter a Contract with us.

3.1. Our shopping pages will guide you through the steps you need to take to place an order with us. Please take the time to read and check your order before confirmation.

3.2. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. Our acceptance of your order will take place by sending you an e-mail that confirms your order and the delivery details (“Order Confirmation”). The Contract between us will only be formed when we send you the Order Confirmation.

3.3. We may be unable to accept your order, which could be due to the Product being out of stock, because we cannot meet your requested delivery date, because of an error in the price or description on our website, because we may not be able to deliver to your destination or because we cannot verify delivery or payment information you have supplied. Should this be the case we will inform you of this by email and we will not process your order. If you have already paid for the Products, we will refund you the full amount as soon as possible.

4.1. We try to ensure that the information, including product descriptions, dimensions and colours displayed on the Website or provided by our customer service team is accurate and as complete as possible. We however do not guarantee accuracy and completeness of such information. Any description and information such as dimensions, the number of stones and carat weights are provided as an indication only and may vary slightly. We have made every effort to display our Products accurately, however the images on our website are for illustrative purposes only. We also cannot guarantee that your screens display of the colours is an accurate reflection of the colour of the Products.

4.2. If you are interested in a Product with natural-coloured stones, the gemstones used can vary in colour and other visual characteristics. All our stones are natural, however when a Product is reproduced, we cannot guarantee the colour will exactly match a previous piece. Each coloured stone product may vary in tone and colour. 

4.3. The Products sizes, colours, dimensions and measurements detailed on our website may not be precise. If you have any questions or would like to receive further specifications about the Products of interest, please do contact us before confirming your order.

4.4. We may make minor changes to the Products to reflect changes in relevant laws and regulatory requirements.

5.1. All Products ordered through our sales channels are subject to availability. Not every Product displayed on our e-commerce or Instagram is available for immediate purchase.

5.2. Should an item be indicated as “Available Online” on our Website this piece will indeed be shoppable through the site and will ship within 10 working days. All other Products would be made to order with a lead time of approximately 10 weeks depending on the Product. Please contact us for more information about how to place special orders or for the status of sold out Products.

5.3. Fernando Jorge reserves the right to change the Products offered for sale on the Website at any time and without notice. 

5.4. Quantity limits may apply on certain orders. We reserve the right to refuse orders exceeding a certain number of authorized products at any moment in time without prior notice.

6.1. Personalisation services, such as engraving or changes to the design, may be available on selected Products. If you wish to have your Products personalised, please contact us with your request and we will let you know whether it will be possible, along with an estimated lead-time and quote.

6.2. If we produce any Products to measurements received by you or are providing resizing or engraving services, you are responsible for ensuring that the measurement and engraving instructions are correct.

6.3. We reserve the right to withhold or refuse acceptance of any order for personalised Products.

6.4. Please contact us for bespoke enquiries, such as engagement rings or other custom design requests (“Bespoke Products”). For Bespoke Products we work with a minimum order value, which we will discuss with you whilst handling your enquiry. Please refer to clause 8.4. for how a bespoke order is charged.

6.5. All sales of products that have been personalised or otherwise made to your bespoke specifications are final and cannot be cancelled or returned to us for exchange or refund (refer to section 11.1.)

7.1. The prices payable for our Products are quoted on our website in GBP£, EUR€ and USD$ and are also indicated on the order pages when you process your order. These prices shown on the product pages of the website or quoted by a Fernando Jorge staff member include sales taxes/VAT only respectively from the UK, Europe and United States.

7.2. If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect. Please see clause 7.5. for what happens if we discover an error in the price of any Product you ordered.

7.3. Currently our online store is fulfilling orders to the United Kingdom, Europe and United States. If you are based in a different location, please contact us for assistance with placing your order directly with a member of our team. If an order is placed directly with us, to ship to a geographical location other than the United Kingdom, Europe or United States, the GBP£ price will apply. The order will be subject to local import duties and taxes, which are levied when the delivery reaches the specified destination. We will not be liable for local duties and taxes for countries outside of the United Kingdom, Europe or United States and you will be solely responsible for payment of any such import duties and taxes. Our logistics team will be happy to provide you with an approximate quote of what your local duties and taxes may amount to.

7.4. We reserve the right to change prices for our products listed on the website at any time and without notice.

7.5. It is always possible that, some of the Products we sell may be mistakenly incorrectly priced. Once an order is placed, we make sure the price of the Product purchased is correct before accepting your order. If the Product’s correct price at your order date is higher than the price stated in our website, we will contact you for further instructions before we accept your order. If we are unable to reach you using the contact details you have provided during the order process, we will cancel the order and notify you in writing.

8.1. We accept payment with the debit and credit cards detailed on our website. You must pay for the Products before we dispatch them. We will charge your credit or debit card once we have confirmed the order and it is being processed. While you process a payment of your purchase by credit card, we will offer you the opportunity for us to retain your credit card information for future purchases. In the event you elect for us to retain your information, the retention of your personal data is subject to the Privacy Policy.

8.2. In the event that the sum due from you cannot be debited for whatever reason (including, without limitation, stopped payment or refusal by the issuer of the card), the sale will be cancelled immediately, and you will be notified in writing.

8.3. We accept payment with debit cards, credit cards and PayPal on the Website. If you wish to make a bank transfer, please contact us and we will accept bank wire transfer for orders at our discretion. We do not charge a fee for bank transfers for orders made, however, some financial institutions may charge a fee for using a bank wire transfer. It is your responsibility to ensure that the payment is net of bank charge and the amount received by us matches the amount that was agreed when placing the order.

8.4. After agreeing all details for a Bespoke Product order, we would charge 50% deposit to confirm. Production would be launched upon receipt of the deposit payment. The remaining 50% balance payment is due when the item is ready to be shipped.

9.1. We offer international shipping free of charge.

9.2. Currently our online store is fulfilling orders to the United Kingdom, Europe and United States. If you are based in a different location, please contact us for assistance with placing your order directly with a member of our team. We will inform you on details and logistics in order to accommodate an alternative shipping destination request.

9.3. Should a Product be indicated as “Available Online” on our website, we will arrange the delivery within 10 working days from Order Confirmation and share tracking details with you via email address provided.

9.4. We will not be responsible if our supply of the Products is prevented or delayed by an event outside our control, but we will contact you as soon as we are made aware of an issue to let you know and we will take steps to minimise the effect of the delay. We will inform you of any such event within 7 days and will arrange a new delivery date with you once the relevant event is over.

9.5. If no one is available at your address to take delivery, we will attempt to deliver to you the next working day.

9.6. We may, allow you to collect any Products you have ordered from our London showroom. If you would like to collect your order, please let us know by selecting the option during the checkout process. The delivery section will allow you to click a box for a London showroom collection. Should you opt in for this option upon submitting your order online, we will contact you to arrange a date and time. Once agreed, when you come to collect your Products, you will be required to bring original photographic proof of your identity such as a passport or identity card together with your payment card used to place the order. You will be able to collect your Product by appointment only during the opening hours of our showroom, Monday to Fridays 10am to 6pm.

9.7. The Product will be your responsibility and owned by you from the time we deliver the Product to the delivery address you gave us or from the time you collect it from us.

9.8. We will repair or replace, free of charge (including costs of re-delivery) any Products which are damaged or lost in transit where delivery is made by our carrier, but only if:

9.8.1. you tell us about the damage or loss within 24 hours of the delivery date in the case of damage and within 24 hours of the delivery date we quoted you after you placed your order in the case of loss.

9.8.2. you produce to us all documents relating to the lost or damaged Products and the original packaging for damaged Products.

9.9. Bespoke Order delivery time frames are discussed when placing an order. We will contact you once a Bespoke Product has been produced and arrange delivery with you accordingly.

10.1. You have a legal right to end the contract with us if:

10.1.1. The product you have bought is faulty (see clause 11.6.) or misdescribed; 

10.1.2. We have told you about an error in the price or description of the Product you have ordered, and you do not wish to proceed, see clause 4;

10.1.3. You have changed your mind, see clause 11.1.

10.1.4. In all other cases if we are not at fault and there is no right to cancel the contract.

11.1. Under the Consumer Contracts Regulations 2013, for most Products bought online you have a legal right to change your mind within 14 days and receive a refund. However, there is no legal right to change your mind in respect of Products which are made to your specifications or are personalised.

The 14-day period starts the day after the day you, or someone you nominate, receives the goods, unless your goods are split into several deliveries over different days. In this case you have until 14 days after the day you, or someone you nominate, receives the last delivery to change your mind about the goods.

11.2. To request to end the contract with us and wish to swap or return a Product for or a refund, you are exercising your right to change your mind. Please contact us at [email protected] and provide your name, home address, order number, and your phone number.

11.3. Unless a product is being returned due to faultiness, we do not cover the cost of any return shipments and it is your responsibility to return the Products to us safely within the first 14 days of receiving your order.

We will ask you to either return the Products in person at an arranged date and time to our London Showroom (Fernando Jorge, 4 Garden Walk, First Floor, London, EC2A 3EQ), or post them back to us.

We recommend that you insure the return shipment, as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them back at our warehouse. We also recommend that you use a secure, trackable shipping method to return your order to the address we will provide you with and retain proof of sending, in case of a dispute.

11.4. When packing to send back your return, please ensure the Product along with its original packaging is in a sturdy box. Please make sure that the Products are placed back in the Fernando Jorge pouch in the presentation box, along with bubble wrap or tissue paper for protection.

11.5. Once we have received the order back, it will be carefully inspected and we have the right to refuse the acceptance of the return, if the Product has not been returned in its original condition, if part of the packaging is missing (jewellery box and pouch) or if the Products show signs of wear.

Should the Products pass the inspection we will refund you the price you paid for the Products, by the method you used for payment. However, we may make deductions from the price as follows:

11.5.1. to reflect any reduction in the value of the goods if they are not in the same condition as they were in when they were supplied; or

11.5.2. to reflect any loss or damage caused as a result of your failure to follow our Returns guidelines.

11.6. Your items should be sent back to us within 14 days of receiving you order. Returns outside this timeframe may be accepted at our discretion and may only be refunded as a store credit or in exchange for another piece.

11.7. If you have any questions or complaints about a Product, please email us at [email protected]. Returning faulty Products will be arranged free of charge. As per The Consumer Rights Act 2015 the Products sold to you must be as described, fit for purpose and of satisfactory quality. This means during the expected lifespan of our products you are entitled to the following:

11.7.1. up to thirty days: if your goods are faulty, then you can get an immediate refund.

11.7.2. up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.

11.8. The agreed refunds will be transferred back to you as soon as possible, but can take up to 14 working days from us received your returned goods.

11.9. Nothing in these terms will affect your legal rights.

12.1. Every repair is reviewed on a case-by-case basis. Please contact us as soon as you notice your product being damaged with a picture of the item. Depending on the nature of the damage and who may have been at fault, we will arrange a return for you and carefully assess the product upon receipt.

12.2. We will repair your item free of charge if it is a manufacturing or material defect. Please note cracking, plating wear (including rhodium or ruthenium plating), chipping or scratching of stones are not considered as manufacturing defects.

We will not be liable for loss of an item, damage caused by accidents, inappropriate use or wear and tear.

12.3. Please refer to our Care Guide for more information on how to look after your jewellery.

13.1. Your use of this Website and any contract between us for the purchase of our Products shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the Courts of England and Wales. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable for these terms and conditions and shall not affect the validity or enforceability of any remaining provisions.

14.1. We are the owner/ licensee of all intellectual property rights on our Website and the material published on it. This includes all images, illustrations, graphics, designs, layout, photographs, audio, videos, logos, artwork, data, computer code, written and other text or script and other materials contained or displayed on our Website (“Content”).

All Content is protected by copyright, trademark and/or other intellectual property rights owned, controlled or licensed to Fernando Jorge Limited. Your use of our Site does not grant you ownership of any Content on our Site. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

14.2. The Contents of the Site and the Site are intended solely for personal, non-commercial use. You may download or copy the contents and other downloadable materials displayed on the Site for the sole purpose of placing an order with us or using the site as a shopping resource.

No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the contents, the site, or any related software.
